Illinois law describes many different types of criminal sexual offenses involving children or Internet solicitation. These offenses range from misdemeanor to felony offenses, with increased penalties for repeat sex offenses and those committed near a school, daycare, park or playground. Child pornography charges can result in a Class 1 felony charge with a mandatory minimum fine of $2,000 and a maximum fine of $100,000. In child pornography cases involving mentally retarded children, it is a Class 3 felony with a mandatory minimum fine of $1,000 and a maximum fine of $100,000.

When the Internet is used for sexual exploitation, a range of charges and penalties can result, including:

  • Indecent solicitation of a child using a computer or other form of communication to arrange a sexual act with a child under age 13

  • Grooming a victim by knowingly using the Internet service or electronic device to solicit or attempt to do so to commit a sex offense
  • Class 4 felony
  • Traveling to meet a minor after using the Internet or electronic device to solicit or attempt to solicit a child
  • Class 3 felony
