Drug possession is typically a felony in Illinois, except in the case of less than 30 grams of marijuana, charged as a misdemeanor. The penalties for drug possession are based on the weight of the drugs in your possession and can increase with aggravating circumstances, such as the presence and discharge of a firearm, a repeat drug offense, or the possession of any illegal drugs near a school, church, park, or movie theater. A first-time offender may be eligible for probation and the expungement of your record after two years. Some often-abused drugs and their penalties include:

  • Marijuana Possession
    • 10 grams or less, fines up to $1,500, up to 30 days to a year in jail, depending upon drug weight
