Drug Possession Charges and Penalties in Chicago

Under the Illinois Cannabis Control Act, more than 10 grams of marijuana possession with intent to deliver is a felony offense. Under the Illinois Controlled Substances Act, intent to deliver a gram or more of cocaine, 5-15 grams of methamphetamine or 10-15 grams of heroin are all felonies. The fines for greater amounts of those substances can be determined using the street value of the drug:

  • Marijuana possession with intent to deliver
    • 10 grams or less, fines up to $1,500 and/or six months in jail or up to $2,500 and/or a year in jail, depending upon weight
    • 10 grams or more, felony, fines from up to $25,000 to $200,000 and/or 1-30 years in prison
  • Controlled substances possession with intent to deliver
    • Cocaine, heroin, meth, morphine and LSD, felony, 15 grams or less, fines of up to $250,000 and/or 4-15 years in prison for
    • 15 grams or more, up to $500,000 and/or 6-60 years in prison
