DUI Penalties in Naperville, Illinois

Driving under the influence with a BAC of 0.08, or having any amount of cannabis, or any drugs or intoxicating substance in your system can be very costly. This is especially so for teens and college students who are frequently arrested for DUIs and face unique charges and penalties. Depending upon the circumstances of your DUI conviction, you may be subject to any of the following:

  • Driver’s license suspension or revocation
  • Heavy fines
  • Forfeiture of your vehicle
  • Participation in an alcohol/substance abuse treatment program
  • Community service
  • Incarceration in jail or penitentiary

For a Class A misdemeanor DUI, the state can impose the following penalties:

  • First or second offense, with BAC of 0.08, a mandatory minimum term of either 5 days of imprisonment or 240 hours of community service, in addition to any other criminal or administrative sanction, 1 year suspended license
  • For transporting a child under 16, an additional 6 months of imprisonment, an additional mandatory $1,000 fine, and 25 days of community service in a program benefiting children
  • First offender DUI with BAC or urine of 0.16, mandatory minimum of 100 hours of community service and mandatory $500 fine
  • Second DUI with BAC or urine of 0.16, a mandatory 2 days in jail and mandatory $1,250 fine

When you commit DUI under circumstances that involve repeat and felony DUI charges, such as driving with no license or driving on a revoked license, DUI resulting in injury, DUI resulting in serious bodily harm, or DUI resulting in death, you will face aggravated felony charges. DUI felonies range from Class 2 to Class X with penalties from a 2-year license revocation to permanent revocation, 240 hours to 25 days of community service, 5 days to 25 years in jail and $500 to $25,000 in fines.
