Repeat and Felony DUI Penalties in Illinois

Charges and penalties for a misdemeanor DUI charge, may be upgraded to an aggravated felony DUI when you are:

  • Driving on a suspended or revoked license for a prior DUI
  • Have two or more previous DUIs - Class 2, years of incarceration
  • Involved in an accident that resulted in bodily harm to a passenger under age 16 - Class 2 felony, 3-7 years prison, $2500 minimum fine, 25 days in community service
  • Stopped without a valid driver’s license - Class 4, 1-3 years incarceration
  • Driving in an uninsured vehicle - Class 4, 1-3 years incarceration
  • Cause an accident resulting in disfigurement, permanent disability or a fatality - Class 4, license revocation for a minimum of 2 years
  • Drunk driving in a motor vehicle, snowmobile, all-terrain vehicle, or watercraft accident that resulted in the death - no probation, 1-12 years for one death, 6-28 years for two deaths
  • Driving a school bus with passengers under 18 years of age on board - Class 4, 1-3 years of incarceration
  • Driving in a school zone on a school day with children present - Class 4, 1-3 years of incarceration

With repeat of DUI felony charges, special circumstances and expanded penalties are incurred. These penalties are in addition to any other criminal or administrative sanctions for DUI and include:

  • Third DUI offense, Class 2 aggravated felony, punishable by 3-7 years of incarceration, possible ten year loss of license; third DUI with child under 16 - mandatory fine of $25,000 and 25 days of community service
  • Fourth (or more) DUI - Class 2, no probation, 2-12 years of incarceration, minimum one year suspension of license; with child 16 in vehicle - mandatory $25,000 fine and 25 days of community service
  • Fifth DUI, Class 1 felony - no probation, 4-15 years of incarceration; with 0.16 BAC or urine - mandatory $5,000 fine; with child under the age of 16 -  $25,000 fine, and 25 days of community service
  • Sixth or higher DUI, Class X felony, 0.16 BAC or urine - added $5,000 fine; with child under 16 - added mandatory $25,000 fine, 25 days of community service 6-30 years of incarceration, revocation or license for life, suspension of vehicle registration
