In 2011, the State of Illinois enacted a new law, called "Julie's Law," that increased penalties for excessive speeding and essentially left offenders with a criminal record. This statue removed the option of court supervision as a sentence that previously would have prevented these criminal charges from appearing as convictions on your Illinois driving record and from causing your insurance rates to rise. With a blemish of a conviction on aggravated speeding, which is now considered a misdemeanor, you might have difficulty keeping your job or finding future employment, and you may not be able to pass a security clearance.

Penalties for Aggravated Speeding in Illinois

With a tougher stance on traffic violations in Chicago and throughout Illinois, those charged with aggravated speeding are subject to:

  • Class A misdemeanor offense
  • $2,500 fine
  • Possible 1 year in jail
  • Possible suspended or revoked license
  • Criminal conviction and record not subject to expungement
  • Increased points on driving record
  • Higher insurance rates
  • CDL disqualification

There are special circumstances that can further increase penalties for aggravated speeding. Tougher fines and sentences may be handed down if you have a prior aggravated speeding or reckless driving charge on your record, if your offense occurred while driving over a bridge, in a school zone or a thoroughfare to a school zone, or in a construction or maintenance zone.

Since the enactment of "Julie's Law", the legislature has further increased the fines and penalties for speeding.  A new class of Aggravated Speeding ticket was created. Now, speeding in excess of 25 miles or more over the posted speed limit, you will be ticketed for a Class B Misdemeanor, punishable by:

  • Up to a $1,500 fine
  • Up to 6 months in jail
  • Possible suspended or revoked license
  • Increased insurance rates
  • Additional points on your driving record
  • CDL disqualification
