Reckless Driving Charges in Illinois

Illinois laws (625 ILCS 5/11-503) state describes reckless driving as driving a vehicle with a "willful or wanton disregard for the safety of persons or property." It notes too that anyone who knowingly drives a "vehicle and uses an incline in a roadway, such as a railroad crossing, bridge approach, or hill, to cause the vehicle to become airborne" commits the offense of reckless driving, with special charges and circumstances as follows:

  • Class A misdemeanor - reckless driving;
  • Class 4 felony - reckless driving causing bodily harm to a child or a school crossing guard in the performance of his/her duties;
  • Class 4 felony - aggravated reckless driving, the offense results in great bodily harm or permanent disability or disfigurement to another; and
  • Class 3 felony - the violation causes great bodily harm or permanent disability or disfigurement to a child or a school crossing guard while the school crossing guard is performing his or her official duties.
