What Parents Should Know About Teen Driving in Illinois

The Illinois Graduated Driver Licensing Program (GDL) imposes strict requirements for teen licensure, and specifies heavy penalties for teens involved in a wide range of traffic violations. Since the 2009 GDL has been in place, Illinois's prosecutions of teen drivers have increased substantially, leading to as much as a 50 percent decrease in teen fatalities and accidents. Among the GDL teen driving requirements of note to parents and legal guardians are:

  • Parents participation in 50 hours (including 10 at night) of teen practice driving
  • Parents can withdraw consent for teen drivers anytime up to age 18
  • Parents can be charged with a crime for providing alcohol to teens, or allowing anyone under 21 to drink in their home
  • In the first 12 months of licensing, and up to age 18, teens are permitted to drive with only one unrelated passenger in the car
  • Teens can have no traffic convictions to graduate through the licensing phase of the GDL Program
  • Drivers under 18 are subject to nighttime driving restrictions, 10pm-6am weekdays, 11pm-6am weekends
  • Parents must accompany ticketed drivers under 18 to court in order for them to get probation
  • Parents of under 18 drivers can access their driving records free online

Penalties for Teen Driving Violations in Illinois

Teen drivers are subject to added requirements and restrictions to maintain driving privileges, including guidelines on wearing seat belts, passenger limits, driving curfews, cell phone use (prohibited through age 19), and driving while texting (totally prohibited). Teens who commit violations of restrictions, or have convictions on traffic offenses, may be subject to the following penalties:

  • A warning letter to the parent and teen
  • A court appearance with a parent
  • Probation
  • Attendance at traffic school
  • The extension of the waiting period before licensure
  • An extension of passenger restrictions
  • License suspension
  • Participation in a remedial education course
  • Retesting
  • A reinstatement fee
  • Total license revocation
